Agreement to Terms

These Terms and Conditions (“Terms”) govern your use of the website at eliseehomeserviceshouston.com and any HVAC installation, maintenance, repair, or related services provided by Elisee AC Services LLC(“Elisee,” “we,” “us,” or “our”), a licensed HVAC contractor located in Cypress, Texas (License No. 145586E).

By booking a service appointment, signing a service authorization, submitting an online form, or using our website, you (“Customer”) agree to be bound by these Terms. If you do not agree, please do not use our services or website.

Services Provided

Elisee AC Services LLC provides the following HVAC services to residential and commercial properties:

  • Air conditioning and heating system installation and replacement
  • Emergency and seasonal HVAC repair and diagnostics
  • Preventive maintenance tune-ups (spring/cooling and fall/heating seasons)
  • Refrigerant handling and recharging (by EPA Section 608-certified technicians)
  • Indoor air quality assessment and humidification services
  • Duct cleaning and sealing
  • Thermostat installation and smart-home integration
  • Heat pump and water heater installation

All work is performed by licensed technicians in compliance with Texas state regulations and applicable local building codes. Elisee reserves the right to decline any service request that falls outside the scope of our licensing or that our technicians determine cannot be completed safely.

Scheduling & Property Access

When you schedule a service appointment, you agree to the following:

  • You are the property owner or an authorized representative with legal authority to authorize HVAC work at the property.
  • A responsible adult (18 years or older) must be present at the property for the duration of the service visit.
  • You will provide our technicians with safe, unobstructed access to all relevant HVAC equipment, electrical panels, and attic or crawl-space access points.
  • You will secure or remove pets from the work area to ensure the safety of both our technicians and your animals.
  • Appointment windows are estimates. While we make every effort to arrive on time, travel times and prior job complexity can affect scheduling. We will contact you if we are running significantly late.

Emergency Services

24/7 emergency HVAC services are available by calling (346) 550-1887. Emergency dispatch fees may apply outside of standard business hours (9:00 AM – 5:00 PM, 7 days a week). Membership plan holders receive priority scheduling and waived emergency response fees as described in Section 6.

Estimates & Pricing

Elisee provides upfront, transparent pricing before any work begins.

Free Estimates: We offer no-obligation estimates for installations, replacements, and major repairs. An estimate is not a binding contract until you authorize the work in writing or verbally.
Diagnostic Fees: A diagnostic fee may apply for service calls. This fee covers the technician's time to identify the issue and is disclosed before the visit. Diagnostic fees are waived for active Membership Plan holders on covered visits.
Flat-Rate Pricing: We price by the job, not by the hour, so you always know the cost before we begin. Prices may vary based on equipment brand, part availability, system complexity, and access difficulty.
Price Validity: Estimates are valid for 30 days from the date provided. Parts and equipment costs are subject to manufacturer pricing changes beyond our control.

The $50 promotional discount advertised on our website applies to qualifying service calls and cannot be combined with other offers unless explicitly stated. Eligibility is subject to change; contact us for current terms.

Payment Terms

Payment is due in full upon completion of the service, unless a prior written payment arrangement has been agreed to by both parties.

Accepted Methods: Major credit and debit cards, ACH bank transfer, and financing (see below). Cash and check are accepted on request.
Financing: Financing options are available through our approved third-party lending partners for qualifying installations and major repairs. Financing terms, interest rates, and approval criteria are set by the lender and are separate from these Terms.
Late Payments: Invoices not paid within 30 days of the service date may be subject to a late fee of 1.5% per month on the outstanding balance.
Returned Payments: A $35 fee applies to any returned check or declined ACH transaction.
Membership Plan Billing: Monthly membership fees are charged automatically to your payment method on file. See Section 6 for plan-specific billing terms.

Membership Plans

Elisee offers four annual membership plans (Bronze, Standard, Silver, and Total Comfort). By enrolling in a plan, you agree to the following terms:

Duration

All plans are 1-year subscriptions billed monthly at the advertised rate ($13, $16, $20, or $30 per month depending on the plan).

Included Visits

Maintenance visits are scheduled by appointment and must be used within the plan year. Unused visits do not carry over.

Discounts

Member repair discounts (10–20% depending on plan) apply to labor and parts on covered repair services. Discounts do not apply to equipment purchases or third-party services.

Cancellation

You may cancel at any time with 30 days' written notice. Discounts applied within 90 days may be invoiced at standard rate. No partial-month refunds.

Plan Transfers

Membership benefits apply to the enrolled property address and are non-transferable to other addresses.

Auto-Renewal

Plans automatically renew at the end of the 12-month term at the then-current rate unless cancelled in writing before the renewal date.

Warranties

Labor Warranty

Elisee warrants all labor performed by our technicians against defects in workmanship for a period of 90 days from the service date. If a covered defect occurs within this period, we will return to correct the issue at no additional labor charge.

Parts & Equipment Warranty

Parts and equipment carry the manufacturer's warranty, which we pass through to you. Warranty terms vary by manufacturer and model. We will provide documentation of any applicable manufacturer warranty at the time of installation or part replacement.

Warranty Exclusions

  • Damage caused by misuse, neglect, unauthorized repairs, power surges, or acts of nature.
  • Normal wear and tear, including consumable components such as filters and belts.
  • Equipment modified or serviced by a non-Elisee technician after our installation.
  • Pre-existing conditions documented at time of service.

Limitation of Liability

To the fullest extent permitted by Texas law, Elisee AC Services LLC's total liability to you for any claim arising out of or related to the services we provide shall not exceed the total amount you paid for the specific service giving rise to the claim.

We are not liable for:

  • Indirect, incidental, consequential, or punitive damages, including loss of use of your HVAC system, spoiled perishables, or loss of business income.
  • Pre-existing structural, electrical, or plumbing deficiencies in your property discovered during a service call.
  • Damage caused by deferred maintenance or failure to follow our technician's recommendations.
  • Delays in service caused by parts unavailability, severe weather, or other circumstances beyond our control.

Elisee maintains general liability and workers' compensation insurance as required by Texas law. Certificate of insurance documentation is available upon written request.

Customer Responsibilities

To receive the best possible service and ensure the safety of our technicians and your home, customers are responsible for:

  • Providing accurate information about your HVAC system, including known issues, previous repairs, and system age.
  • Maintaining the area around outdoor and indoor HVAC units clear of obstructions, vegetation, and stored items (a minimum 24-inch clearance is recommended).
  • Replacing air filters at the frequency recommended by your system manufacturer (typically every 1–3 months).
  • Notifying us promptly of any new issues or concerns following a service visit within the warranty period described in Section 7.
  • Ensuring that any required permits for HVAC work are obtained. Associated permit fees are the customer's responsibility unless quoted otherwise.

Cancellation & Rescheduling

Cancellations: You may cancel or reschedule a scheduled appointment at no charge with at least 4 hours' advance notice by calling (346) 550-1887.
Late Cancellations: Cancellations with less than 4 hours' notice may result in a trip charge equal to the diagnostic fee to cover the technician's dispatched time.
No-Shows: If our technician arrives at the scheduled address and is unable to access the property or reach the customer, the appointment will be treated as a late cancellation.
Our Cancellations: In the rare event we must cancel an appointment, we will notify you as early as possible and prioritize rescheduling at the next available time convenient for you.

Intellectual Property

All content on our website — including text, graphics, logos, photographs, and service descriptions — is the property of Elisee AC Services LLC and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or use our content for commercial purposes without prior written permission.

Customer-submitted reviews and testimonials remain your property, but by submitting them you grant Elisee a non-exclusive, royalty-free license to display them on our website and marketing materials.

Dispute Resolution

We are committed to resolving any dispute quickly and fairly. If you have a concern about a service, please contact us directly first — most issues can be resolved with a single conversation.

Informal Resolution

Contact us at (346) 550-1887 or info@eliseehomeserviceshouston.com. We will acknowledge your concern within 1 business day and work toward resolution within 5 business days.

Formal Process

If informal resolution is unsuccessful, disputes shall be resolved by binding arbitration administered in Harris County, Texas, under the rules of the American Arbitration Association (AAA). You retain the right to file a complaint with the Texas Department of Licensing and Regulation (TDLR) at any time. Nothing in these Terms prevents you from filing a claim in small claims court for disputes within the court's jurisdictional limits.

Governing Law

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. You agree to the exclusive jurisdiction of the courts of Harris County, Texas for any matter not subject to arbitration under Section 12.

If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
